General Guidelines for Trademark Registration in Thailand
Trademark Registration in Thailand depends on DIP (Department of Intellectual Property, member of WIPO) The first important thing to note is that each trademark application that is filed covers only a single trademark, so if you file an application containing your brand name and a logo together, then the scope of trademark protection is for that specific arrangement & combination of both features; that is the application won’t protect each of the components separately.
Brand and Logo Registration
If your brand name includes a standard character trademark (i.e. XYZ HEALTHCARE) then you may register your brand name in any font, colour and/or combination of uppercase and lowercase letters. This wil guarantee a broad protection since your use of the trademark is covered anyway by the trademark registration.
If you want to protect your brand name in a particular font/style, you could apply for the non-standard character trademark. The scope of Trademark registration will cover your brand name in the chosen style/font, and therefore the protection is less broad than filing a standard character trademark.
Design Trademark
A design trademark filed independently from Brand Name will protect the features and arrangement of your logo/design separately from it. As well, if no specific colour is indicated, registration shall protect your logo regardless of colors. This way, you’ll be able to use the logo/design in any colourbeing covered by trademark registration.
Composite Trademark
If your budget is small you may consider applying for your brand logo and name in one single brand registration. In this case you have toconsider that scope of protection for the composite trademark is limited to the specific mixture & combination of logo and name. The Trademark registration will not cover the single components of the composite brand.
Following the above, if you register a composite brand name it is important to continue to use the exact layout and combination of the trademark on your labesl, adveritising and Commercial Registration (i.e. Thai FDA Regsitration) in order to maintain a proper trademark registration for a composite trademark.
Conclusions
If you are considering the use of your logo and name brand separately from each in other in the future, we strongly recommend that you apply for two applications separately for each of such components.
As well, if you think you are thinking you may change the font used for brand name displaying, then you might consider applying for a standard character trademark to have the flexibility to make such changes in the future.
